These Terms and Conditions govern all orders, purchases, and interactions with Decobake, including custom cake orders, corporate orders, and related services. By placing an order with Decobake, you agree to be bound by these Terms and Conditions.
1. About Decobake
Decobake specializes in custom cakes and baked goods, with a primary focus on corporate and event-based cake orders. We do not sell baking supplies or ingredients.
2. Orders and Customization
2.1 Custom Orders
All cakes and products are made to order. Design references, themes, colors, and sizing must be finalized before confirmation. Minor variations in color, decoration, and finish may occur due to the handmade nature of our products.
2.2 Design Approval
Clients are responsible for reviewing and approving all design details prior to production. Once production has started, changes may no longer be accommodated.
2.3 Order Confirmation
An order is considered confirmed only after:
- Full or required down payment is received, and
- Order details are acknowledged by Decobake
3. Pricing and Payments
3.1 Pricing
Prices are based on size, complexity, design, ingredients, and delivery requirements. All prices are quoted in Philippine Peso (PHP) unless stated otherwise.
3.2 Payment Terms
- Full payment may be required for custom and corporate orders.
- Accepted payment methods will be communicated during the ordering process.
- Production will not begin until payment requirements are met.
3.3 Additional Charges
Additional charges may apply for:
- Rush orders
- Major design revisions
- Special ingredients
- Delivery outside standard coverage areas
4. Cancellations, Changes, and Refunds
4.1 Cancellations
Due to the custom nature of our products:
- Payments are non-refundable once production has started.
- Cancellations made before production may be subject to administrative or material costs.
4.2 Order Changes
Requests for changes must be made as early as possible and are subject to availability and additional charges.
4.3 Refund Policy
Refunds are only considered in cases of:
- Proven production error by Decobake
- Failure to deliver due to Decobake’s fault
Refunds will not be issued for changes in preference, minor aesthetic differences, or third-party delivery issues.
5. Delivery and Pick-Up
5.1 Delivery Schedule
Delivery times are estimated and may be affected by traffic, weather, or unforeseen circumstances. Decobake is not liable for delays caused by factors beyond our control.
5.2 Risk Transfer
Once the product has been picked up or successfully delivered, responsibility for handling, storage, and consumption transfers to the client.
5.3 Incorrect Details
Decobake is not responsible for failed or delayed deliveries due to incorrect addresses or contact details provided by the client.
6. Storage and Handling
Clients are responsible for proper storage of cakes and baked goods. Decobake is not liable for damage caused by:
- Improper storage
- Exposure to heat or moisture
- Mishandling after delivery or pickup
7. Allergies and Dietary Information
Decobake products may contain or come into contact with common allergens including dairy, eggs, nuts, soy, and gluten. While we take precautions, we do not guarantee allergen-free products.
Clients are responsible for informing guests of potential allergens.
8. Intellectual Property
All designs, images, content, and materials created by Decobake remain our intellectual property unless otherwise agreed in writing. We reserve the right to photograph and display completed products for marketing and portfolio purposes.
9. Limitation of Liability
To the fullest extent permitted by law, Decobake shall not be liable for:
- Indirect or consequential damages
- Allergic reactions
- Issues arising from improper handling after delivery
Our total liability shall not exceed the total amount paid for the order.
10. Force Majeure
Decobake shall not be held responsible for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, power outages, government restrictions, or emergencies.
11. Privacy
Personal information collected during ordering is used solely for order fulfillment and communication purposes. We do not sell or share customer data with third parties except as required to fulfill the order or by law.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
13. Updates to Terms
Decobake reserves the right to update or modify these Terms and Conditions at any time without prior notice. The latest version will always apply to new orders.
